The Associated Press LOS ANGELES The father of soul singer Marvin Gaye was charged yesterday afternoon with murder in the shooting death of his son following an argument over a misplaced letter, authorities said. Marvin Gaye 70, will be arraigned today in Superior Court, said Al Albergate, spokesman for the district attorney's office. "We have not specified the degree of murder," Albergate said.

"It could be first-or second-degree." Deputy District Attorney Robert Schirn, who filed the charge, decided against a manslaughter count because "of the state of mind of the shooter," Albergate said. "There were two shots fired and there was a significant lapse of time between shots to warrant the filing of a murder charge," Schirn said. Gaye Sr. was arrested Sunday at home, where he allegedly shot the sweet-voiced Motown star after quarrelling over a lost letter from an insurance company, said Lt. Robert Martin, commander of the detectives investigating the shooting.

Martin, who previously said there had apparently been "bad blood" between father and son, said Sunday's argument over the missing letter began between the elder Gaye and his wife, Alberta, 71. "He, in the process of looking, was yelling at his wife to help him find it. She didn't want to," he said. "At one point Marvin Jr. interceded and indicated to his father that he shouldn't be yelling.

One thing led to another and ultimately shots were fired," Martin said. There was "no significant issue at all," he said. "The content of the letter was immaterial."
