Martino has denied a defense motion to dismiss a 12-yearold indictment against Joseph Donahue, a former Union City resident now serving a 35-year-to-life sentence for murder. Judge Martino said yesterday any delay in sentencing Donahue for crimes committed in Ocean County resulted from Donahue's actions, and not from any breakdown in the state's judicial system. Donahue was convicted before former Ocean County Court Judge Robert F.

Novins i in March 1963 of carrying a concealed weapon, a revolver, in Brick Township April 22, 1962, and of attempting to use the weapon upon William G. Townsend there. He fled the state prior to sentencing, and was apprehended by the Federal Bureau of Investigation in South Weymouth, in May 1964. At that time the FBI elected to turn Donahue over to New York County authorities to face a murder charge. He was convicted before Superior Court Judge Charles Marks Feb.

19, 1965, of the April 22, 1964 murder of Lawrence Krebs, a New York bartender. Judge Marks sentenced Donahue to Attica State Prison April 9, 1965, and authorities there say he is considered too dangerous to bring here for sentencing. Donahue is awaiting trial on another murder charge in New York, and is considered a suspect in four other murders there. Liquor License Transfer Held WALL TOWNSHIP The Township Committee has held for study and decisior. at its next meeting.

Dec. 26, an application for the transfer of a plenary retail consumption license from the Cloud Room, Rte. 34, to the Allaire Lounge and Liquors 1732 Rte. 35. At the meeting last night.

the Committee heard testimony presented by Chester Apy, a Red Bank lawyer, who represented the applicant, Mr. and Mrs. John Azzolina, as well as from objectors to the license transfer represented by Keith Henderson, an Asbury Park lawyer. "What we have is a competitor (Jonathan Craig Liquors, Rte. 35) objection to competition," Apy said.

"He finds it uncomfortable to find that his plans to enlarge (his establishment) will be fau' ed by a competitor. But-1 think that competition furthers the business of an area in terms of variety offered. If there is competition, the needs of the residents are being met by the competition." Apy noted that the applicant had agreed to a number of things if the transfer is 3 Judges Grant 11 Divorces approved. including limiting the hours of operation of the package store from 9 a.m. to 10 p.m.

Monday through Saturday; the elimination of pool tables or shuffleboards. as well as juke boxes, live music and dancing. "The character of the businessman coming in is 0. consideration." Apy said. "Mr.

Azzolina is no fly night operator." Apy said that the ABC (Alcoholic Beverage Commission) had approved the plan. Henderson commented, "The intent is to run a package goods store. I have objections to the ABC approving of the plans before the municipal body has heard the plan. Also take into account the heavy traffic in the area, and the number of other licenses in the area." Henderson said that the Azzolina family operates three package goods stores in Keyport, Middletown Township, and Ocean Township and that although the licenses are shared by parents and their son, the Committee should look into "the substance of the ownership."
