Charge Won't Be Dropped TOMS RIVER Superior Court Judge Edward V. Martino has denied a defense motion to dismiss a 12-year-old indictment against Joseph Donahue, a former Union City resident now serving a 35-year-to-life sentence for murder.

Judge Martino said yesterday any delay in sentencing Donahue for crimes committed in Ocean County resulted from Donahue's actions, and not from any breakdown in the state's judicial system. Donahue was convicted before former Ocean County Court Judge Robert F. Nov-ins in March 1963 of carrying a concealed weapon, a revolver, in Brick Township April 22, 1962, and of attempting to use the weapon upon William G. Townsend there. He fled the state prior to sentencing, and was apprehended by the Federal Bureau of Investigation in South Weymouth, in May 1964.

At that time the FBI elected to turn Donahue over to New York County authorities to face a murder charge. He was convicted before Superior Court Judge Charles Marks Feb. 19. 1965, of the April 22. 1964 murder of Lawrence Krcbs, a New York bartender.

Judge Marks sentenced Donahue to Attica State Prison April 9, 1965. and authorities there say be is considered too dangerous to bring here for sentencing. Donahue is awaiting trial on another murder charge in New York, and is considered a suspect in four other murders there. a Mi' llfi Ui vl' '( u( mA (if 51 'If TJ John C.
